are the powers and duties the zba a quasi judicial body appellate jurisdiction independent of the governing body ie cairo town council what is a variance a variance provides an exception to and relief from the strict application of the zoning ordinance should be granted infrequently a variance is a safety valve that provides an exception to and relief from the strict application of the zoning ordinance. the premise here is that even the best of zoning ordinances cannot anticipate all eventualities and circumstances that might merit the occasional well justified exception to the rule. the variance undoubtedly represents not only the bulk of the work of the zoning board of appeals but also has caused the greatest confusion and frustration for these boards. variances should be granted infrequently yet they are often overused. they should not be allowed to permit leakage from the certainty provided by local zoning or zoning will cease to function as intended to guide growth and development within communities. types of variances area variance provides relief from dimensional requirements e.g. yard setbacks road frontage lot coverage or height limits use variance allows land to be used for a purpose not allowed by the zoning regulations there are two types of variances that may be granted. the area variance provides relief from the dimensional bulk or density requirements of the zoning ordinance. examples include relief from required minimum lot sizes yard setbacks frontage or depth requirements lot coverage parking requirements or height or building size limits. the use variance allows land to be used for a purpose not allowed by the zoning regulations. the alternative would be to ask the legislative body to rezone the property. area variances weigh the benefit to the applicant against the detriment to the health safety and welfare of the neighborhood or community. the zba must consider whether ۱. the neighborhood character would change ۲. alternative solutions are possible ۳. the variance is substantial ۴. there would be adverse impacts and ۵. there is a self created difficulty in reviewing proposed area variances the zoning board of appeals must weigh the benefit to the applicant against the detriment to the health safety and welfare of the neighborhood or community. this is a balancing test. the zba must consider whether the neighborhood character would change with the granting of a variance whether alternative solutions other than an area variance are possible whether the variance request is substantial whether there would be adverse impacts on the environment and whether the difficulty is self created. while the zba must consider all these factors it can give more weight to some than others in rendering its decision. even so the zba should attempt to make decisions consistent with the purpose of local zoning and not use the board to protest zoning provisions it does not support. the following slides will discuss each of the five considerations in turn. adverse impacts whether the proposed variance will have any adverse effect or impact on the physical or environmental conditions in the neighborhood or district are zba must evaluate whether the alleged difficulty was self created which consideration shall be relevant to the decision of the board but shall not necessarily preclude the granting of the area variance. often this means there is not enough land to meet required setbacks for the type scale and location of development proposed. such a circumstance is considered to be a self created difficulty if the existing restrictions were in place at the time the land was purchased. in other words the buyer beware principle applies here. even so the zba may still issue an area variance if it feels this factor is not as significant as the other four considerations it has weighed. standards for review statutory standards must be used a variance is an appeal burden of proof for applicant is high minimum relief only conditions may be attached findings of fact needed the specific review standards that must be used in evaluating variance requests are set forth in state statute but also must be stated in the local law or ordinance for the zba to have the authority to address them. the local review standards should be identical to the state’s. an appeal for a variance can only be made by one who has been denied a permit or who has been served with some other type of enforcement action. the burden of proof for the applicant particularly for use variances …
